Refund/Exchange Policy Healing Stones From the Heart, Inc. maintains a no refund policy. Our products are professionally packaged and shipped "INSURED" by the carrier. Occasionally, an item may be damaged in shipment. Please inspect merchandise upon arrival. It is the purchaser's responsibility to notify carrier of any damages. Should your marker incur damage during shipment, please note the damages to the delivery driver and on any bill of lading or delivery receipt. In addition, please contact us immediately at: customerservice@healingstonesfromtheheart.com and fax a copy of the bill of lading or delivery receipt so we can help you file a claim promptly. The shipping company will need to know the exact damage to the memorial. If possible, you should take a photo when you uncrate it, after first noting the damage on the bill of lading or delivery receipt. It is important to inspect the memorial immediately. If a product is damaged in shipping you must make a claim with the shipper and further, notify us within 48 hours of your receipt. All merchandise should be retained in the original shipping container in the same condition when damage was discovered until an inspection can be done. While Healing Stones From the Heart, Inc. will assist in filing a claim for damages, we are not responsible for the memorial after delivery has been accepted. We will try and expedite the replacement of markers damaged in shipping. However, your order, yet it may take another 6 to 8 weeks to receive since this product is made to order, especially if your order included a customized plaque. Incorrect Order If you received an incorrect product, please notify us via email at customerservice@healingstonesfromtheheart.com and include the following information: first and last name, address, telephone number, email address, order number, a description of the item you received and a description of what was ordered. Provided the error was the fault of Healing Stones From the Heart, Inc., we will supply you with an RMA number for you to return the merchandise. You must notify us within 24 hours by email after you received the product. We will try and expedite your order. However, it may take 6 to 8 weeks to receive a replacement, since the product is made to order, especially if your order included a customized plaque. Cancellation Policy Your order with Healing Stones From the Heart constitutes a binding legal agreement. However, you may cancel your order within 48 hours of placement by submitting a written request via email to customerservice@healingstonesfromtheheart.com. The following information must be included in order to cancel your order: first and last name, address, telephone number, email address, order number and the reason for your cancellation. If your account has already been charged, we will refund the amount provided the cancellation is within 48 hours of the initial order.Notwithstanding the foregoing statements, under no circumstances will a refund be given if the order is not cancelled within 48 hours of the initial order. In addition, customized orders that include plaque engraving and/or photos cannot be cancelled and are excluded from the cancellation policy. Delivery Typical delivery time is 6 to 8 weeks following placement of your order. However, unforeseen delays in delivery may result due to circumstances outside our control. Healing Stones From the Heart is not liable for delays caused by suppliers or delays in shipping, including but not limited to delays due to weather, acts of God, natural or man-made disasters, unavailability of materials, and the like. Since the memorials weigh between 46 and 75 pounds, it is important to be prepared to receive such a heavy item. It is the responsibility of the consumer to provide the proper equipment to move the memorial and install it properly. Healing Stones From The Heart, Inc. is not liable for any injuries suffered during installation or moving the memorial from one place to another, nor for any damages to the product or individuals. Installation The memorial is made with the highest quality materials and craftsmanship. However, it can be damaged if not properly installed. Healing Stones From the Heart recommends that all memorials be set in the ground by a professionally licensed and insured contractor with experience in the installation of memorial markers. In addition, the cemetery or memorial park where you intend to install the marker may require that it be installed by a licensed monument dealer or company providing monument installation services. The cemetery or memorial park may also charge a fee prior to installation of the marker or have limitations on the size and/or design of the markers it permits to be installed. It is the consumer's obligation to determine any prerequisites to installation. Therefore, you should contact the location where you intend to install the memorial prior to placing your order to ascertain any requirements regarding installation or size and design. Healing Stones From The Heart, Inc. is not liable for any direct, incidental or consequential damages resulting from installation or from an inability to install the marker at the intended location. Disclaimers and Warranty Healing Stones From The Heart, Inc. warrants to the original purchaser that the marker will be free from defects in materials and workmanship for a period of one year following the date of delivery to the consumer. Healing Stones From The Heart's sole obligation under the foregoing warranty is, at our sole option, to repair, replace or correct any such defect. The warranty is void if any damage or defects result from improper installation or damage from outside agents or forces, including, but not limited to, lawn and garden equipment, accidents, abuse, misuse, improper care, misapplication, storage damage, or negligence, or if there has been any alteration or modification of the marker by any party other than Healing Stones From the Heart, Inc. Healing Stones From the Heart, Inc. does not authorize any person or party to assume or create for it any other obligation or liability in connection with the product except as set forth herein. THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER INDEMNITIES OR WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. In the event applicable law imposes any implied warranties, the implied warranty period is limited to ninety (90) days from the date of receipt. Some jurisdictions do not allow such limitations on duration of an implied warranty, so the above limitation may not apply to you. IN NO EVENT SHALL HEALING STONES FROM THE HEART, INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, SUCCESSORS OR ASSIGNS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, OR USE INCURRED BY CUSTOMER OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT, OR TORT, OR OTHERWISE EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. HEALING STONES FROM THE HEART, INC.'S LIABILITY FOR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THE DEFECTIVE PRODUCT. THE PROVISIONS OF THIS AGREEMENT ALLOCATE THE RISKS BETWEEN HEALING STONES FROM THE HEART, INC. AND CUSTOMER. HEALING STONES FROM THE HEART, INC. S PRICING REFLECTS THIS ALLOCATION OF RISK AND BUT FOR THIS ALLOCATION AND LIMITATION OF LIABILITY, HEALING STONES FROM THE HEART, INC. WOULD NOT HAVE ENTERED INTO THIS AGREEMENT. SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, IN WHICH CASE THE ABOVE LIMITATION MAY NOT APPLY TO YOU. terms and conditions stated therein. Governing Law This use of this website and any Agreement or contract that may be entered into with Healing Stones From the Heart, Inc. for the purchase of a memorial marker(s) is governed by the laws of the State of Delaware without application of the principles of conflicts of law. The Superior Court of the State of Delaware, in and for New Castle County shall have exclusive jurisdiction to hear any and all disputes, suits or claims brought by or against Healing Stones From the Heart, Inc. or its directors, officers, employees, affiliates, successors or assigns or other representatives resulting from the use of this website or arising from the purchase of any memorial marker(s) from Healing Stones From the Heart, Inc. |
